House Passes Legislation to Repeal Controversial Portion of ObamaCare

WASHINGTON, D.C. – The House has passed H.R. 5 the Protecting Access to Health Care (PATH) Act, legislation sponsored by Georgia Representative Phil Gingrey (GA-11).   H.R. 5 enacts reforms to medical malpractice liability laws (medical tort reform) for health care lawsuits brought in state and federal courts. It also repeals the creation of the Independent Payment Advisory Board (IPAB).

“I am proud that, on the eve of ObamaCare’s second anniversary, the House has passed legislation to repeal one of the worst aspects of the law,” stated Westmoreland.  “While I would prefer a full repeal of ObamaCare, repealing smaller portions of the law is still a successful way to stopping the harmful impact this law is already having.”

IPAB is one of the most controversial aspects of the health care law.  It is a board comprised of 15 appointed members and designed to control the rate of growth of Medicare spending.  Opponents are concerned this bureaucratic-controlled board would have the ability to ration health care for seniors, making decisions whether or not to approve life-saving procedures for Medicare patients.

“Health care choices should be made by patients and their doctors,” stated Westmoreland.  “Instead, ObamaCare – the epitome of a bureaucratic nightmare – established a board of 15 government bureaucrats to ration health care to our seniors.  Government bureaucrats have no business making life or death decisions for our nation’s seniors.  I am proud to be a cosponsor of this legislation and encourage the Senate to pass this bill as soon as possible.”

March 23rd marks the second anniversary of ObamaCare.  Next week, the U.S. Supreme Court will hear arguments on the lawsuit challenging the constitutionality of the law’s individual mandates.  In addition, next week, the House is expected to pass the FY2013 Republican Budget that would once again repeal the legislation.

  1. Come on Westmoreland! The Palin Death Panel arguement is all you have! Please have more respect for the intelligence of those you represent. That dog simply won’t hunt! To start with it’s,repectfully, a total lie.. and anyone who researched it knows it is.Tell me sir, how will this affect YOUR governmant paid health insurance paid for by US, the people you are supposed to represent. With Ga’s legislatures “good old boys” exposed as the most corrupt legislature in all 50 states, can you honestly say you conferred with your constituents on this or just did you just go along with your Gold Dome good old boy network ? I’m thinking the latter.
