Insurance Fraud case placed on December trial calendar

(Franklin, GA) — The felony insurance fraud case against former Franklin Mayor Brad Yates will continue next month following his appearance in Heard County Superior Court Wednesday.

Yates and his defense attorney, Stuart Mones, appeared before Judge Dennis T. Blackmon Wednesday morning at Franklin City Hall where proceedings are being held while construction is still ongoing at the Heard County Courthouse.

After a short discussion between the attorneys and Judge Blackmon, the case was placed on the Criminal Court Jury Trial calendar for December 3, 2019.

Yates was arrested on Tuesday, December 5, 2017, and initially charged with 32 counts of felony Insurance Fraud along with one felony count of False Statements to a State Law Enforcement Agency.

The investigation was conducted by the Georgia State Board of Workers’ Compensation’s Enforcement Division.

Yates declined to comment following Wednesday’s court appearance.

According to the press release issued at the time by Enforcement Division Director Stan Bexley, the initial results of the investigation alleged that Yates fraudulently took premium dollars for workers’ compensation insurance policies that were never issued and instead issued his clients bogus certificates of insurance as proof that they had workers’ compensation insurance coverage.

Yates was officially indicted by a grand jury in Heard County Superior Court on 30 counts of Insurance Fraud and one count of false statements on Sept 17, 2018.
